The Employment Committee presents the third in our legal series, "Starting Your Own Production Company.” Developing a career as a freelance producer is challenging enough, taking the next step to form your own company can seem even more daunting. But it doesn’t have to be.

Whether you’re forming a company for freelance work, a movie or setting up shop for a multi-series deal there are a number of issues you’ll need to address. Loan out vs. Production Company? Corp, LLC or Partnership? How you answer these questions will affect your taxable income, your liability and your relationship with your employees. Even if you’re the only employee!

This forum will cover:
• Formation
• Taxation
• Liabilities
• Trademark & Copyright issues

On the panel to help sort through the issues of formation are Thea J. Kerman and Nancy L. Adams, moderated by Nelle Nugent.

Thea J. Kerman is Of Counsel at Beigelman, Feiner & Feldman, P.C. She has over twenty five years of legal experience and is an expert in the entertainment, publishing and licensing industries. Thea represents a wide range of creative clientele that includes producers, writers and directors. She is licensed to practice in New York and California.

Nancy L. Adams is a CPA and partner at Adams & Salter, CPA’s, PC with over twenty five years of experience. She has a Masters in Taxation from Pace University and has worked with award winning clients in all segments of the entertainment industry including talent, crew and production.

Nelle Nugent has produced more than 60 B’way, touring, Off-B’way and West End productions including: Dracula, The Elephant Man, Morning’s at Seven, Mass Appeal (MTC) Amadeus, Nicholas Nickleby, Sly Fox (revival), American Buffalo (revival), and Little House on the Prairie, The Musical; as well as numerous independent feature films and MOW’s. She recently completed an independent feature film based on Athol Fugard’s "Master Harold”…and the boys, which was shot on location in South Africa. Her awards include: five Tonys, two Obies, two NY Drama Critics Awards and numerous film and TV awards. Ms. Nugent co-founded the Producers Guild of America East - a trade association of film, television and new media producers. She is an elected member of its Executive Committee and is co-chair of the Recruitment Committee. Ms. Nugent is a long-time member of the Broadway League and of the Television Academy of Arts and Sciences.

A 45 minute presentation on the issues will be followed by a 45 minute question and answer period.
